A copy of these terms and conditions must be signed by all new Clients at the time of submission of work to Dot Creation, indicating agreement to and acceptance of these Terms and Conditions. Alternatively, payment of an advance fee is an acceptance of our terms and conditions.
Unless otherwise agreed any quotation provided will be valid for 15 days from the date of receipt. Dot Creation reserves the right to alter a quotation after expiry of the 15 days.
Should the client decide that changes are required after work on the website, including initial design work, has commenced, an additional fee may be payable.
Unless otherwise agreed, all website services require an advance payment of 60% before work will commence. The remaining 40% of the project quotation will be due upon completion of the work.
Note: We are taking Domain and Hosting charges in advance.
Should the client wish to cancel at any point during the project any advance payments are not refundable. If, at the point of cancellation the advanced payment does not cover the work already undertaken by Dot Creation, the client will be invoiced accordingly.
Once the work has been completed to the client’s satisfaction, Dot Creation will send an invoice via email. If clients wish to receive a hard copy of their invoice then it their responsibility to ensure Dot Creation is aware of this. Payment is due within 15 days upon receipt of the invoice.
Payments can either be made by cheque or bank transfer. Cheques should be made payable to Dot Creation. Bank details will be made available on invoices.
Accounts that are outstanding after 15 days will result in a reminder being sent. Accounts that have not been settled within 5 days of our reminder will incur a late payment charge of 10% of the amount outstanding.
If after this 5 day period the account has still not been paid, Dot Creation reserve the right to remove the client’s website from the internet. Once the invoice has been paid in full the client’s website will be restored but an additional fee is payable.
In situations where the client provides text, images, animations, layouts or any other content for their website they are legally responsible for ensuring that this material does not infringe any copyright. Dot Creation will not be held responsible for any breach of copyright for any materials provided by the client.
Dot Creation reserves the right to display a link to the client’s website in our portfolio page. We also reserve the right to display ‘Designed’ and/or ‘Powered by Dot Creation’ on the client’s website. This statement will form part of a link back to Dot Creation own website.
Dot Creation will aim to complete the client’s website by the date agreed between both parties but cannot be held responsible for delays in content delivery by the client.
Dot Creation will make every effort to design the client’s website so it displays consistently in the most popular current browsers. We cannot accept responsibility for the display of a client’s website in new versions of browsers released after the client’s website has been launched.
Dot Creation will submit a client’s website to several of the major search engines as part of the design quotation. We cannot guarantee a high placing in any search engine results. After submission to either a search engine, online directory or any such site, Dot Creation can accept no responsibility or liability if these sites choose not to list the client’s website.
Future Support And Content Updates
Your website will be handed over as a fully functioning, completed work. Unless it has been agreed beforehand Dot Creation is not responsible for future support, but this can be provided upon request for an agreed fee. Updates to the websites content (text and images) can be provided for a fee of Rs.1500/- INR/PM.
Future Site Issues
Dot Creation can not be held responsible for issues caused by malicious software, spy ware, viruses, and website hacking or any illegal actions by either the client or by others once the website has been launched.
Should Dot Creation waive any of these terms on an individual basis, this shall not affect the validity of remaining clauses or commit Dot Creation to waive the same clause on any other occasion.
By agreeing to these terms and conditions your statutory rights are not affected. Dot Creation reserves the right to change or modify any of these terms or conditions at any time.
We hate spam just as much as you do. We will never share your information with third parties unless required to do so by law or requested by you. The information we collect from you will be used to maintain your services with us and to represent the quality of our work to others, such as in our online portfolio.
Upon completion of a custom website design and payment of web design and development fees, the client is the owner of the commissioned website. The client may continue to use the commissioned website to promote the client’s company or organization regardless of whether he/she chooses to continue further services with Dot Creation. The client does not have the right to resell the design or development to other companies. The client does have the right to add pages onto the existing site or have another company add pages onto the existing site using the commissioned website design/development.
Website domain names are leased from domain name registration companies. When Dot Creation registers a domain name for a client, that registration will be made in the client’s name. Upon payment of any outstanding fees, the client has the right to use that domain name regardless of whether he/she chooses to continue further services with Dot Creation. Domain name renewal and renewal fees are the responsibility of the client. Clients are advised to closely monitor the renewal date of a registered domain name. If the client chooses to have Dot Creation renew the domain name on behalf of the client, an additional service fee may apply.
All text and photos used as content in a commissioned website must be provided by the client. The client must have ownership or written permission to use all content he/she provides for use. Dot Creation cannot be responsible for copyright infringements on behalf of clients.
Dot Creation cannot complete a website if the client does not provide content (the text and/or photos to be used in the website). If Dot Creation is waiting for content or other pieces of information or administrative steps (such as domain passwords, hosting passwords, required third party services, etc.), the client will be notified. If the client fails to handle the requests in a timely manner, the website may be delayed. (Professional writing and photography services are available for a surcharge if the client needs assistance with content development.) If the client-driven delays continue, Dot Creation will complete as much of the project as possible without the missing elements. In order to keep all accounts current, Dot Creation may bill for the completed project and add missing elements later at they are received. If more than 30 days from the website design and build has passed, and the client still has not submitted the remaining missing content, Dot Creation reserves he right to consider the project complete in its entirety and bill for future work.
Due to web page load time considerations and the flat rate charged for web pages, there is a limit on what can be included in a single web page. A web page can hold the equivalent of about 2 and ½ pages of the content that would typically fit on an 8 ½” x 11” piece of paper. If the content is straight text without any pictures, tables, graphs, etc., this equates to a maximum of 2000 words. If there are pictures, or tables, etc., then less text will fit. Additionally, a web page may include up to a maximum of six photos on a page. A photo gallery page with limited text may contain up to ten photos. If a client’s content does not fit within these parameters, one or more additional web pages should be purchased.
Unless otherwise specified in the design contract, sub pages of any website will use the same design as the home page. Mockups are not provided for sub pages. Formatting requests for sub pages will be considered but will not be guaranteed. If the client requires specific looks or formatting for sub pages, this request should be made at the time of the initial contract and may incur additional fees.
Clients who have signed up for a maintenance plan receive discounts off the web designer’s monthly rates for website updates. The standard monthly maintenance plan is enough time to add about five photos and a few paragraphs of text. Clients on a Dot Creation web maintenance plan may send update requests via email (contact us for the correct email address). Routine maintenance which fits into the allotted time specified in the client’s maintenance plan is typically completed in about three to four business days. If a client on a website maintenance plan requests more than the scheduled amount of maintenance, he/she will be given a quote and, if approved, the additional work will be completed at a discounted rate and the turnaround time will be based on workload issues. Monthly maintenance plan fees are separate from hosting fees and may be cancelled at any time.
Clients whose websites are hosted by Dot Creation have access to emergency technical support 24 hours a day. In the event of a website hosting outage, clients should leave a voicemail message and a technician will be paged. The phone number is listed on the Contact Us page of our website. Please note, technical support cannot be provided for clients’ individual computer issues.
One-half of the initial website design and development fees are due upon project initiation. Upon project completion, the remaining balance is due in full within five business days. Once the remaining balance is paid in full, the completed website will be moved from the staging server to the client’s server so the website will go live. At that time.
We guarantee we will make a sincere effort to perform quality work as outlined in these terms of service. However, we cannot guarantee your website will draw traffic or result in increased sales or any other result you may seek other than what is in writing in your signup agreement. We will make a sincere effort to handle any problem that is brought to our attention, yet we cannot be held responsible for any potential loss of revenue or other perceived detrimental outcome.
Most every client would like his/her website to rank high in search engine results for selected keywords, yet search engine results are determined by a multitude of constantly changing factors, third party search engines, and the amount and quality of competition on the world wide web. Dot Creation guarantees certain search-engine friendly techniques will be used in the creating of each custom website, such as keywords in the title bar at the top of the browser, the Meta tags in the hidden coding behind the scenes, and alternate text behind some images. If the keyword placement in these three areas is not to the client likes, Dot Creation will change these three items to the client’s choices one time for free. Subsequent or additional changes will be billed at the standard hourly rate. Dot Creation cannot be held responsible for search engine results.
If the client changes his/her mind about doing work with Dot Creation during the course of the initial web design or development phase, the client will be responsible for the amount of work already completed. Depending on the amount of work completed at the time of cancellation, this may mean receiving a full refund, a partial refund, no refund, or owing additional fees.
Third party vendors may have separate terms of service agreements. Dot Creation cannot be held liable for disputes with third party vendors.
Dot Creation reserves the right to decline to do business with any client for any reason.
Dot Creation reserves the right to change these terms of services at any time for any reason.
